December Drops Weekly Contest at McDonald’s (“Contest”)
Official Rules (the "Official Rules")
1. Overview.
McDonald’s Restaurants of Canada Limited (“Sponsor”) is providing its customers with a December Drop Weekly Contest at McDonald’s restaurants in Canada (“Contest”) through its McDonald’s app (the “App” or “McDonald’s app”). The App provides customers with various weekly food discounts or other food-related offers, nutrition information and benefits. The food discounts and other food-related offers may vary in content and number in different regions of Canada.
In these Official Rules, an Eligible Person (refer to Rule 2) who has an eligible entry (an “Entry”) into the Contest recorded on their behalf is called a “Participant”. Participants agree to comply in full with all of the provisions of these Official Rules. A Participant who does not currently have the McDonald’s app will need to download, register and activate the App to participate in the Contest with an electronic device that is compatible with the App’s system requirements (“Digital Device”) and a valid email address. Go to Rule 9 for Digital Device requirements.
2. Conditions of Eligibility.
Subject to the provisions of this Rule 2, the Contest is available to individuals residing in Canada who have reached the age of majority in their jurisdiction of residence at the time they become a Participant.
Persons in any of the following categories are not eligible to participate in, or to win the prize (the “Prize”) in the Contest:
- a. any person who is not a resident of Canada and at least the age of majority in their jurisdiction of residence;
- b. any person who, on or after June 1, 2022, was or is a director, officer, employee, member, manager, agent or franchisee of any of the Contest Entities (refer to Rule 3);
- c. any individual engaged in the development, production or distribution of materials for the Contest; and
- d. any person who is or purports to be an immediate family member (defined as spouse, dependent for federal income tax purposes, step-, biological, foster, in-law or adoptive parent, sibling, child) of, or who resides or is domiciled in the same household as, any person in any of the preceding categories.
In these Rules, a person who is eligible to enter the Contest is called an “Eligible Person”.
3. Contest Entities.
In these Official Rules, the term “Contest Entities” means Sponsor, Prize Partners and their respective parent companies, subsidiaries, affiliates or related companies, franchisees, local advertising cooperatives and app developers, digital/advertising/promotion agencies, and the Redemption Centre (defined in Rule 6).
4. The Contest Period.
The Contest period begins on December 1, 2022, at 12:00:00 a.m. Eastern time (“ET”) and ends on January 2, 2023, at 11:59:59 p.m. ET (the “Contest Period”) and includes five separate weekly entry periods (each a “Weekly Entry Period”) as follows: Weekly Entry Period 1 begins on December 1, 2022, at 12:00:00 a.m. ET and ends on December 4, 2022, at 11:59:59 p.m. ET; Weekly Entry Period 2 begins on December 5, 2022, at 12:00:00 a.m. ET and ends on December 11, 2022, at 11:59:59 p.m. ET; Weekly Entry Period 3 begins on December 12, 2022, at 12:00:00 a.m. ET and ends on December 18, 2022, at 11:59:59 p.m. ET; Weekly Entry Period 4 begins on December 19, 2022, at 12:00:00 a.m. ET and ends on December 25, 2022, at 11:59:59 p.m. ET; Weekly Entry Period 5 begins on December 26, 2022, at 12:00:00 a.m. ET and ends on January 2, 2023, at 11:59:59 p.m. ET. Each Weekly Entry Period has its own prizes, which can be found in Rule 7.
5. How To Enter.
An Eligible Person who wishes to enter the Contest may do so using their Digital Device to access the McDonald’s app installed on it, and have a valid email address and postal code registered in the App settings. An Eligible Person may also enter the Contest without a Digital Device or making a purchase as outlined in Rule 5.B. An Eligible Person will receive one Entry into the current Weekly Entry Period (and not any subsequent Weekly Entry Period) when they:
A. Enter Via the McDonald’s App:
An Eligible Person who is signed in to their McDonald’s app account and clicks on the entry tile or banner found on the McDonald’s app during the Contest Period will be taken to an entry form that the Participant must complete including to provide all the information requested, to correctly answer the skill-testing question (“Skill-Testing Question”) without assistance of any kind, agree to the Official Rules and submit their entry. One Entry into the Weekly Entry Period based on the date the Participant submits the entry form will be recorded on behalf of the Participant, subject to the daily limit set out below in Rule 5.C.
B. Alternate Method of Entry (“AMOE”):
If an Eligible Person wishes to have one Entry recorded on their behalf during any Weekly Entry Period without using the McDonald’s app, that Eligible Person must submit an entry at the AMOE Website. If an AMOE is received after the deadline, no Entry will be recorded on behalf of the person who submitted that Entry. One Entry will be recorded on behalf of a Participant that completes and provides all of the information requested, including the correct answer to the Skill-Testing Question without assistance of any kind, agrees to the Official Rules and submits their entry. One Entry into the Weekly Entry Period based on the date the Participant submits the entry form will be recorded on behalf of the Participant, subject to the daily limit set out below in Rule 5.C. (Each Entry is referred to as an “Entry” and collectively as “Entries”.) An Entry will not be recorded on behalf of a Participant that incorrectly answers the Skill-Testing Question.
C. Limits:
There is a limit of one Entry per Eligible Person per Weekly Entry Period (based on local time) regardless of method of entry. There is a limit of one Prize per Participant per Weekly Entry Period in connection with the Contest.
6. How To Win.
A. McDonald’s Contest Draws/Winner Notifications and Odds of Winning:
On or about December 8, 2022, at approximately 3:00 p.m. ET, the Sponsor’s redemption centre, located at 55 W. Monroe, Chicago, IL 60603, USA (the “Redemption Centre”), will randomly select one winning Entry for each available Prize from among all Entries submitted with the correct answer to the Skill-Testing Question recorded during Weekly Entry Period 1. The Redemption Centrewill follow the same process stated directly above on December 15, 2022, for Weekly Entry Period 2 drawing, and on January 10, 2023, for Weekly Entry Periods 3, 4 and 5. Subject to the provisions of these Official Rules, the Participant whose Entry is selected as the winner will be notified to that effect by the Redemption Centre as follows:
Week 1, Week 3, and Week 4 Weekly Entry Period Winners will receive their prize in approximately eight to ten weeks following the respective drawing shipped to the address provided on their entry form.
Week 2 and Week 5 Weekly Entry Period Winners will receive a Prize claim document (the “Prize Claim Document”) via email from DocuSign. Those Prize winners must complete and submit the Prize Claim Document electronically by the date specified on the prize claim document.
For potential winners of the Week 2 and 5 Draws, if the Redemption Centre finds that the Prize Claim Document is properly completed and submitted, then the Redemption Centre will make arrangements for the winner to receive the Prize.
If the Prize winner fails to contact the Redemption Centre as set out above or fails to properly complete and return the prize claim form or Prize Claim Document by the deadline, then that Prize winner will be disqualified from the Contest and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for how to win the Prize will apply to that Participant. The Sponsor will contact up to three backup Participants for each of the Week 2 and Week 5 Prizes, if needed. If the prize cannot be awarded, the Prize will be forfeited and will not be awarded in the Contest. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that Prize winner will not have any claim against the Contest Entities or against any other person, firm or corporation in respect of the Prize, the Contest or any matter related to the Contest.
The odds of winning a Prize for a Weekly Entry Period will depend on the number of Entries received for that Weekly Entry Period.
7. Prizes, Approximate Retail Value (“ARV”):
Weekly Entry Period 1: 500 Prizes: Each winner will receive one adult, one-size-fits-all; McDonald’s-logo’d Snuggie.ARV: $80
Weekly Entry Period 2: 5 Prizes: Each winner will receive a 5-day/4-night Gourmet Inclusive® Experience for two at Azul Beach Resort Negril (the “Resort”) that includes: round-trip, economy-class air transportation for winner and guest from the major international airport near winner’s home in Canada to Montego Bay, Jamaica, 5 days/4 nights’ accommodations at the Resort (One double-occupancy room), food and beverages at the resort (subject to any limitations or restrictions), non-motorized water sports, gratuities, and some entertainment and round-trip ground transfers between Montego Bay airport/Resort. Each winner will also receive a $200 CDN cheque for a transportation stipend to be used for transportation to/from the major international airport nearest their residence in Canada. Prize includes airport/resort transports in Jamaica. Trip must be completed by January 31, 2024, and is subject to certain conditions, blackout dates and restrictions in Rule 8. ARV: $4,900 CDN.
Weekly Entry Period 3: 1,000 Prizes: Each winner will receive a Coke/McDonald’s-branded pajama set, adult-size L/XL, ARV $39.
Weekly Entry Period 4: 1,000 Prizes: Each winner will receive a set of four Chicken McNuggets® logo’d stockings, ARV: $65.
Weekly Entry Period 5: 10 Prizes: Each winner will receive their choice of either a Super Chexx Pro bubble hockey machine or a Super Kixx Pro bubble soccer machine (winner can customize a few elements of prize choice), from Innovative Concepts in Entertainment, Inc. (ICE), ARV: $5,745-$6,745.
8. Prize/Entry Conditions/Restrictions.
Any matters concerning Prizes that are not contemplated by these Official Rules, will be determined by Sponsor in its sole discretion. Expenses not specifically stated as included in the Prizes are the sole responsibility of the Prize winners.
Additional Terms Applicable to Weekly Entry Period 2 Prize: Any and all costs, fees (including, but not limited to, luggage/checked baggage fees, airport fees or duties) and expenses not expressly stated in the prize description are the sole responsibility of the prize winner. Winner and guest are also responsible for any additional tours, discretionary gratuities, fees, discretionary hotel and dining charges, meals in alternative dining venues, ultra-premium beverages, boutique purchases and any other incidental costs or other expenses not specifically set forth in the Official Rules. If winner chooses to travel without a guest, air transportation, accommodations and other elements of stay at Resort will be modified to as to be suitable for actual number of travelers; and, in such case, winner will not receive an alternate or substitute prize for the difference. Any difference between the approximate retail value and the actual value will not be awarded and any difference will not be refunded. No insurance is provided as part of the prize, and obtaining any insurance, such as but not limited to travel insurance, health, accident or medical insurance, and property loss or damage insurance is the sole responsibility of the winner and/or winner’s guest(s) (if any). Travel and other arrangements must be booked at least twenty-one days prior to arrival at the Resort and will be determined by Sponsor or Prize Partner (where applicable). Certain blackout days apply, including Easter (4/2/23 – 4/9/23); US Thanksgiving (11/17/23 – 11/27/23); and Christmas through New Year’s (12/21/23 – 1/1/24). Air transportation will be round-trip (originate from and end at the same airport), economy-class from and to a major international airport selected by Sponsor. Reservations must be made, and tickets issued prior to travel. Tickets and certificates are non-refundable and non-transferable and are not redeemable for cash. Changes to reservations are not permitted. Prize winner and guest must travel together on the same itinerary and are solely responsible for having any required travel-related documents (including valid government-issued photo ID and/or any required passport or visa) at least seven calendar days prior to departure, as well as fulfilling any/all travel and security requirements (including but not limited to any vaccinations or other health requirements necessary to visit certain destinations). Requirements may vary depending upon whether a given individual has been vaccinated against COVID-19/Coronavirus. Sponsor or Prize Partner reserve the right in their respective sole discretion to designate all flight/travel particulars and route or routes (as the case may be). Failure to complete the trip portion of the prize (or any portion of the prize) does not relieve the prize winner of their tax obligations associated with winning the trip prize. Flight schedules are subject to change without notice. No Released Parties (as defined below) will be liable for any missed opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. A prize winner must be available to travel on dates approved by Sponsor and all travel must be completed by January 31, 2024. If a winner (and/or the winner’s guest[s]) is/are not able to participate in any portion of a travel prize, that unused portion will not be substituted for cash or any other prize. Prize winners may be required to provide a current valid major credit card at time of hotel check-in to cover incidentals, and any and all costs, fees and expenses not expressly stated in the prize description. Restrictions and/or blackout dates may apply to some trip prizes. Once a guest is determined, that guest cannot be changed without the express consent of Sponsor, which may be withheld for any reason. A Minor will not be allowed to participate in any portion of the Prize without being accompanied by their parent/legal guardian. Each winner and each guest agree to maintain their behaviour in accordance with all applicable laws and generally accepted social practices in connection with participation in any prize-related activity. Prize winners understand and agree that Sponsor or the applicable Prize Partner has the right, in its sole discretion, to disqualify and remove a prize winner and/or any guest from any activity at any time if that winner or guest’s behaviour at any point is uncooperative, disruptive, or may or does cause damage to person, property or the reputation of Sponsor or the Prize Partner, or otherwise violates the policies of the Sponsor or Prize Partner. The prize winner is solely responsible for the behaviour of winner’s guests. If any activity relating to any prize is cancelled or postponed for any reason, the balance of that prize will be awarded in full satisfaction of the prize awarded.
General Entry Conditions:
Each Participant acknowledges and agrees that the decisions of Sponsor and/or the Redemption Centre are and shall be final, binding and conclusive in all matters relating to the Contest. Any person attempting to forge Prize Claim Documents or to defraud Sponsor in any way in connection with this Contest may be prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified, and any Prize potentially won will be forfeited in Sponsor’s sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The Prize winner may be required to show proof of being the registered account holder.
9. General Release And Conditions of Participation.
Participants assume all risk of transmission, mailing, loss, damage, destruction, delay and misdirection of Prize Claim Documents and are advised to obtain insurance where appropriate. The Contest Entities are not responsible for:
a. incomplete, mislabeled, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Entries, Prize Claim Documents or other Contest-related materials whether caused by Participants, postal or courier services, wireless carriers, Internet Service Providers (“ISP”) or unauthorized human intervention;
b. any damage to a Participant’s or other person’s computer system or Digital Device that is caused or occasioned by accessing the McDonald’s app, by participating in the Contest or by claiming the Prize;
c. technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Contest;
d. miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;
e. any technical malfunctions, failures, or difficulties, printing errors or omissions, clerical, typographical or other errors or omissions in any Contest advertisement or other materials or postings or any Prize Claim Documents;
f. any errors, omissions, or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;
g. any incorrect or inaccurate information, whether caused by the McDonald’s app or tampering, hacking or by any equipment or programming associated with, or utilized in the Contest; or
h. the incorrect or inaccurate capture of information or the failure to capture or loss of any information.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Prize Claim Documents and Entries submitted become the sole property of Sponsor and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Contest, each Participant hereby releases and agrees to hold the Contest Entities and all of their respective shareholders, officers, directors, agents, representatives and employees (collectively the “Released Parties”) harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Contest or in any Contest-related activity or the receipt, use or misuse of the Prize or portion thereof. Participants waive the right to assert as a cost of winning the Prize, any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim the Prize. By participating in the Contest, the Prize winner hereby agrees and grants Sponsor has the right, but not the obligation, to the use of their name, voice and likeness, along with their address (city and province/territory) and any statements made by or attributed to such Prize winner in any and all media, now known or hereafter devised, without prior notice, review, comment or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with the Sponsor, the Contest and other promotions without further compensation, and releases the Contest Entities from any liability with respect thereto.
10. Digital Device Requirements.
Using a Digital Device and/or operating system not supported by the McDonald’s app may prevent participation in the Contest. While all efforts are made to support current operating systems and Digital Devices based on the McDonald’s app System Requirements, new operating systems and/or Digital Devices may not be supported if brought to market after the development of this Contest. Sponsor is not responsible for any browser or device supporting issues.

11. Miscellaneous.
A. General:
It is each Participant’s responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.
B. Force Majeure/Printing and Production Errors or Omissions:
Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Contest, in whole or in part, or to modify, suspend or extend the Contest, if it determines, in its sole discretion, that the Contest in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity and/or feasibility of the Contest. In the event that, in the Sponsor’s sole opinion, the Sponsor is impeded or prevented from continuing with the Contest as planned or intended by any event beyond its control, including, but not limited to, pandemic, fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Contest.
C. Invalidity:
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.
D. Governing Law:
Subject only to the provisions respecting Quebec residents as set out in Rule 11.F. of these Official Rules:
(a) all Participants, the Sponsor and all other parties hereby attorn to the jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Contest; and,
(b) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Contest shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction’s laws.
E. Language or Other Discrepancy:
In the event that there is a discrepancy or inconsistency between the English-language version and the French-language version of these Official Rules or of any Prize Claim Documents), the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest Materials or in the Prize Claim Documents, or in advertising or other publicity or materials or communications concerning or related to the Contest, and the provisions in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.
F. Quebec Residents:
Residents of the Province of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses et des courses et des jeux (“Régie”) for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
G. Privacy:
Sponsor will collect, use and disclose information, including personal information, provided by Participants in connection with the Contest for the purposes of administering the Contest and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from Sponsor about its products and upcoming contests and promotions. The Contest may be hosted on servers in the United States, and the personal information provided by Participants may therefore also be subject to the laws of the United States. Except as otherwise contemplated in these Official Rules, personal information collected, used and disclosed by the Sponsor in connection with the Contest will be dealt with by the Sponsor in accordance with the Sponsor’s online privacy policy.
H. Cooperation in Prize Award Event(s):
In consideration of being awarded the Prize in the Contest, the Prize winner (and if the Prize winner is a minor, their parent or legal guardian) agrees to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of a Prize to such Prize winner.
I. Official Rules Availability:
These Official Rules will be available at the Contest Website until 2/1/23. To receive a copy of the Official Rules via mail, a Participant should mail, in a postage-paid outer envelope, a self-addressed, postage-paid inner envelope to December Drop Contest at McDonald’s Official Rules Request, P.O. A Participant who wishes to download, register and activate the App to participate in the Appstakes will need an electronic device that is compatible with the App's system requirements ("Digital Device") and a valid email address. The Participant then must download the free App from the App Store on iOS, or Google Play on the Android operating system, and install and activate the App on their Digital Device. Go to Rule 9 for Digital Device requirements.
2. Conditions of Eligibility.
Subject to the provisions of this Rule 2, the Appstakes is available open to individuals residing in Canada who are 13 years of age or older at the time they become a Participant.
Persons in any of the following categories are not eligible to participate in or to win the prize (the “Prize”) in the Appstakes:
- a. any person who is not a resident of Canada;
- b. any person who, on or after June 1, 2022, was or is a director, officer, employee, member, manager, agent or franchisee of any of the Appstakes Entities (refer to Rule 3);
- c. any individual engaged in the development, production or distribution of materials for the Appstakes; and
- d. any person who is or purports to be an immediate family member (defined as spouse, dependent for federal income tax purposes, step-, biological, foster, in-law or adoptive parent, sibling, child) of, or who resides or is domiciled in the same household as, any person in any of the preceding categories.
In these Rules, a person who is eligible to enter the Appstakes is called an "Eligible Person".
3. Appstakes Entities.
In these Official Rules, the term "Appstakes Entities" means Sponsor, and its respective parent companies, subsidiaries, affiliates or related companies, franchisees, local advertising cooperatives and app developers, digital/advertising/promotion agencies, and the Redemption Centre (defined in Rule 6).
4. The Entry Period.
The Appstakes period begins on December 1, 2022, at 12:00:00 a.m. local time ("LT") and ends on January 2, 2023, at 11:59:59 p.m. LT (the "Appstakes Period").
5. How To Enter.
An Eligible Person who wishes to enter the Appstakes using their Digital Device must visit a participating McDonald's restaurant with their Digital Device that has the McDonald's app installed on it, and a valid email address and postal code registered in the App settings. An Eligible Person may also enter the Appstakes without a Digital Device or making a purchase as outlined in Rule 5.C. An Eligible Person who wins a Prize will require a Digital Device to redeem the Prize (as defined below). An Eligible Person will automatically receive one Entry into the Appstakes when they:
A. Earn MyMcDonald's Rewards Points:
An Eligible Person may earn MyMcDonald’s Rewards Points by completing a transaction (minimum $1 pre-tax purchase) using the App (which occurs when the Eligible Person picks up the order at the restaurant), or by scanning or providing their MyMcDonald’s Rewards code when making a purchase at the in-restaurant counter or kiosk, or at the drive-thru during the Appstakes Period. One Entry will be recorded on behalf of the Participant when they complete the transaction, subject to the daily limit set out below in Rule 5.D.
Note: If for any reason the Participant does not complete their purchase, then no Entry will be recorded. If due to any mechanical, technical or human error, a Participant's order can't be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.C. for no purchase Entry.
B. Redeem MyMcDonald's Rewards Points:
An Eligible Person may spend points in a transaction using the App, or by scanning or providing their MyMcDonald’s Rewards code at the in-restaurant counter or kiosk, or at the drive-thru during the Appstakes Period. One Entry will be recorded on behalf of the Participant when they complete the transaction, subject to the daily limit set out below in Rule 5.D.
Note: If for any reason the Participant does not complete their purchase, then no Entry will be recorded. If due to any mechanical, technical or human error, a Participant's order can't be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.C. for no purchase Entry.
C. Entry Via Mail Without Earning or Redeeming MyMcDonald's Rewards Points:
If an Eligible Person wishes to have one Entry recorded on their behalf without earning or redeeming MyMcDonald’s Rewards Points on any purchase, that Participant must submit an entry by mail (a “Mail-in Entry”) as follows: The Participant must manually print in ink and legibly on a piece of paper their complete name, street address (including unit number (if applicable), province/territory and postal code), a daytime telephone number (including area code) and their valid email address; then that Participant must place that paper in a postage-paid envelope, and mail it to: December Drop Appstakes Entry, P.O. Box 12446, Saint John, New Brunswick, Canada, E2L 5E7. A Mail-in Entry must be postmarked by January 2, 2023, and received no later than January 11, 2023 (the “AMOE Received By Date”). Outer envelopes for Mail-in Entries with no return address will NOT be honoured. Mail-in Entries that are sent in business-reply envelopes, sent in envelopes that utilize or bear address labels or stickers, that are photocopied, hand-stamped, computer-generated or otherwise mechanically produced or reproduced, that are not addressed manually in ink, that fail in any way to comply with the requirements set out above in this sub-paragraph or that are not mailed separately in separate envelopes bearing sufficient postage will NOT be honoured (i.e., there can be only one Mail-in Entry per envelope). If a Mail-in Entry is received after the AMOE Received By Date, no Entry will be recorded on behalf of the person who submitted that envelope. One Entry will be recorded on behalf of a Participant for each Mail-in Entry they submit during the Appstakes Period that is received on or before the AMOE Received By Date, subject to the daily limit set out below in Rule 5.D. that is in full compliance with the requirements set out in this Rule 5.C. (Each Entry, including a Mail-in Entry, are collectively referred to as “Entries”.)
D. Limits:
There is a limit of two Entries per Eligible Person per day (based on local time) regardless of method of entry. There is a limit of one Prize per Participant in connection with the Appstakes.
6. How To Win.
A. McDonald's Appstakes Draw/Winner Notification and Odds of Winning:
On or about January 20, 2023, at 3:00 p.m. ET, the Sponsor's redemption centre, located at 55 W. Monroe, Chicago, IL 60603, USA, (the "Redemption Centre") will randomly select one potential winning Entry and three backup potential winning Entries (each a "Backup Entry") for each available Prize from among all Entries recorded during the Appstakes Period. Subject to the provisions of these Official Rules, the Participant whose Entry is selected first as a potential winning Entry will be the potential Prize winner, and that potential Prize winner will be notified to that effect by the Redemption Centre by email as follows: the potential winning notification will be sent via email within three business days following the date of the draw to the email address associated with the potential Prize winner's App account or, in the case of a Mail-in Entry, to the email address provided in the Mail-in Entry. The potential Prize winner will be required to contact the Redemption Centre, in accordance with the information provided in the email, including to provide their preferred language (English or French) to receive correspondence, and to do so by the date stated in that email. If that contact occurs, the Redemption Centre will supply any potential Grand Prize winner with a Prize claim document (the "Prize Claim Document") via DocuSign. The potential Prize winner must complete and submit the Prize Claim Document electronically by the deadline stated in the Prize Claim Document. Prize winners will receive a prize claim form via email. The Prize Claim Document will include a statement of eligibility, release of liability, a publicity release, and a mathematical skill-testing question (the "Skill-Testing Question") that must be correctly answered by the potential Prize winner without any assistance (whether electronic, mechanical or otherwise). The potential Prize winner must follow the instructions in the Prize Claim Document to complete and submit the Prize Claim Document. If the potential Prize winner is a minor in their province or territory of residence, the potential Prize winner's parent or legal guardian must complete the Prize Claim Document on the potential Prize winner's behalf.
If the Redemption Centre finds that the Prize Claim Document is properly submitted and completed (and that the Skill-Testing Question is correctly answered), then that potential Prize winner will be declared the winner of the Prize. If the potential winner completes the prize claim form including a correct answer to the Skill-Testing Question and timely returns the form per instructions in the email, the Prize will be added to the winner's account no later than February 24, 2023.
If the potential Prize winner fails to contact the Redemption Centre as set out above or fails to properly complete and return the Prize Claim Document by the deadline, or if their answer to the Skill-Testing Question is not correct or no answer to the Skill-Testing Question is provided, then that potential Prize winner will be disqualified from the Appstakes and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for how to win the Prize will apply to that Participant. The Sponsor will contact up to three backup Participants for each Prize. If the prize cannot be awarded, the Prize will be forfeited and will not be awarded in the Appstakes. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that potential Prize winner will not have any claim against the Appstakes Entities or against any other person, firm or corporation in respect of the Prize, the Appstakes or any matter related to the Appstakes.
The odds of winning a Prize will depend on the number of Entries received during the Appstakes Period.
7. Prizes, Approximate Retail Value ("ARV"):
Ten Grand Prizes: Ten Grand Prizes are available to be won in the Appstakes. Each prize winner ("Winner") will receive one million, forty thousand (1,040,000) MyMcDonald's Points (i.e., 20,000 points x 52 weeks). Points will be deposited in a winner's MyMcDonald's rewards account in two separate deposits of 520,000 points each, approx. six months apart. Points expire on the first day of the sixth month that follows the month of deposit in a MyMcDonald's rewards account. Failure to create a MyMcDonald's Rewards Loyalty Account through the McDonald's app by January 31, 2023, may result in a forfeiture of the Prize at Sponsor's discretion. Prizes are subject to terms and conditions of the MyMcDonald's rewards program. See Program Terms for details. ARV: $737.29 per Prize.
8. Prize/Entry Conditions/Restrictions.
Any matters concerning Prizes that are not contemplated by these Official Rules, will be determined by Sponsor in its sole discretion. Expenses not specifically stated as included in the Prizes are the sole responsibility of the Prize winners
General Entry Conditions:
Each Participant acknowledges and agrees that the decisions of Sponsor and/or the Redemption Centre are and shall be final, binding and conclusive in all matters relating to the Appstakes. Any person attempting to forge Prize Claim Documents or to defraud Sponsor in any way in connection with this Appstakes may be prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified, and any Prize potentially won will be forfeited in Sponsor's sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The Prize winner may be required to show proof of being the registered account holder.
9. General Release And Conditions of Participation.
Participants assume all risk of transmission, mailing, loss, damage, destruction, delay and misdirection of Prize Claim Documents and are advised to obtain insurance where appropriate. The Appstakes Entities are not responsible for:
- a. incomplete, mislabeled, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Entries, Prize Claim Documents or other Appstakes-related materials whether caused by Participants, postal or courier services, wireless carriers, Internet Service Providers ("ISP") or unauthorized human intervention;
- b. any damage to a Participant's or other person's computer system or Digital Device that is caused or occasioned by accessing the McDonald's app, by participating in the Appstakes or by claiming the Prize;
- c. technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Appstakes;
- d. miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;
- e. any technical malfunctions, failures or difficulties (including failures to correctly scan the MyMcDonald’s Rewards code), printing errors or omissions, clerical, typographical or other errors or omissions in any Appstakes advertisement or other materials or postings or any Prize Claim Documents;
- f. any errors, omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;
- g. any incorrect or inaccurate information, whether caused by the McDonald's app or tampering, hacking or by any equipment or programming associated with, or utilized in the Appstakes; or
- h. the incorrect or inaccurate capture of information or the failure to capture or loss of any information.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Appstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Appstakes, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Prize Claim Documents and Mail-in Entries submitted become the sole property of Sponsor and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Appstakes, each Participant hereby releases and agrees to hold the Appstakes Entities and all of their respective shareholders, officers, directors, agents, representatives and employees (collectively the "Released Parties") harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Appstakes or in any Appstakes-related activity or the receipt, use or misuse of the Prize or portion thereof. Participants waive the right to assert as a cost of winning the Prize, any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim the Prize. By participating in the Appstakes, the Prize winner hereby agrees and grants Sponsor has the right, but not the obligation, to the use of his or her name, voice and likeness, along with his or her address (city and province/territory) and any statements made by or attributed to such Prize winner in any and all media, now known or hereafter devised, without prior notice, review, comment or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with the Sponsor, the Appstakes and other promotions without further compensation, and releases the Appstakes Entities from any liability with respect thereto.
10. Digital Device Requirements.
Using a Digital Device and/or operating system not supported by the McDonald's app may prevent participation in the Appstakes. While all efforts are made to support current operating systems and Digital Devices based on the McDonald's app System Requirements, new operating systems and/or Digital Devices may not be supported if brought to market after the development of this Appstakes. Sponsor is not responsible for any browser or device supporting issues.

11. Miscellaneous.
A. General:
It is each Participant's responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.
B. Force Majeure/Printing and Production Errors or Omissions:
Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Appstakes, in whole or in part, or to modify, suspend or extend the Appstakes, if it determines, in its sole discretion, that the Appstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity and/or feasibility of the Appstakes. In the event that, in the Sponsor's sole opinion, the Sponsor is impeded or prevented from continuing with the Appstakes as planned or intended by any event beyond its control, including, but not limited to, pandemic, fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor's control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Appstakes.
C. Invalidity:
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.
D. Governing Law:
Subject only to the provisions respecting Quebec residents as set out in Rule 11.F. of these Official Rules:
(a) all Participants, the Sponsor and all other parties hereby attorn to the jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Appstakes; and,
(b) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Appstakes shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction's laws.
E. Language or Other Discrepancy:
In the event that there is a discrepancy or inconsistency between the English-language version and the French-language version of these Official Rules (or of any Prize Claim Documents), the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Appstakes Materials or in the Prize Claim Documents, or in advertising or other publicity or materials or communications concerning or related to the Appstakes, and the provisions in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.
F. Quebec Residents:
Residents of the Province of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses et des courses et des jeux ("Régie") for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
G. Privacy:
Sponsor will collect, use and disclose information, including personal information, provided by Participants in connection with the Appstakes for the purposes of administering the Appstakes and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from Sponsor about its products and upcoming contests and promotions. The Appstakes may be hosted on servers in the United States, and the personal information provided by Participants may therefore also be subject to the laws of the United States. Except as otherwise contemplated in these Official Rules, personal information collected, used and disclosed by the Sponsor in connection with the Appstakes will be dealt with by the Sponsor in accordance with the Sponsor's online privacy policy.
H. Cooperation in Prize Award Event(s):
In consideration of being awarded the Prize in the Appstakes, the Prize winner (and if the Prize winner is a minor, their parent or legal guardian) agrees to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of a Prize to such Prize winner.

1. Overview.
McDonald's Restaurants of Canada Limited ("Sponsor") is providing its customers with a Coffee For A Year Appstakes at McDonald's restaurants in Canada ("Appstakes") through its McDonald's app (the "App" or "McDonald's app"). The App provides customers with various weekly food discounts or other food-related offers, nutrition information and benefits. The food discounts and other food-related offers may vary in content and number in different regions of Canada. The App offers customers the ability to place orders, earn MyMcDonald's Rewards points, redeem offers or deals and, if required, pay for those offers, deals or orders via a valid charge, credit or debit card (a "Payment Card") that the customer enters in their App settings in order to easily pick up (and pay for) their food at a participating McDonald's restaurant via "Mobile Ordering".
Note: a person under the age of majority in their jurisdiction of residence should only use mobile payment with the permission of a parent/legal guardian.

A. Purchasing any Hot Beverage Using the McDonald's App:
An Eligible Person may use the App to order any hot beverage (Premium roast coffee, tea, latte, cappuccino, americana, mocha, deluxe hot chocolate, espresso or double espresso) by completing a transaction using their McDonald's App or by scanning or saying their MyMcDonald's Rewards code at the restaurant counter, kiosk or Drive-thru to earn points. One Entry will be recorded on behalf of the Participant when they complete the order purchase (via points, MOP or cash) at a participating McDonald's restaurant.
Note: If by reason of any problem, whether mechanical, technical, due to human error or omission or other means the order cannot be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.B. for no purchase Entry.
B. Entry Via Mail Without Making a Purchase:
If an Eligible Person wishes to have one Entry recorded on their behalf without scanning a MyMcDonald's Reward on the purchase of any Premium roast coffee, tea, latte, cappuccino, americano, mocha, deluxe hot chocolate, espresso, double espresso), that Participant must submit an entry (a "Mail-in Entry") as follows: The Participant must manually print in ink and legibly on a piece of paper their complete name, street address (including unit number (if applicable), province/territory and postal code), a daytime telephone number (including area code) and their valid email address; then that Participant must place that paper in a postage-paid envelope, and mail it to: McDonald's Coffee For A Year Appstakes Entry, P.O. Box 12442, Saint John, NB E2L 5E7. A Mail-in Entry must be postmarked no later than October 3, 2022 (the "AMOE Postmarked by Date") for receipt by October 17, 2022. Outer envelopes for Mail-in Entries with no return address will NOT be honoured. Mail-in Entries that are sent in business-reply envelopes, sent in envelopes that utilize or bear address labels or stickers, that are photocopied, hand-stamped, computer-generated or otherwise mechanically produced or reproduced, that are not addressed manually in ink, that fail in any way to comply with the requirements set out above in this sub-paragraph or that are not mailed separately in separate envelopes bearing sufficient postage will NOT be honoured (i.e., there can be only one Mail-in Entry per envelope). Or not received by the deadline, no Entry will be recorded on behalf of the person who submitted that envelope. One Entry will be recorded on behalf of a Participant for each Mail-in Entry they submit that is in full compliance with the requirements set out in this Rule 5.B. (Each Entry, including a Mail-in Entry, are collectively referred to as "Entries".)
C. Limits:
There is a limit of three Entries per Eligible Person per day (based on local time) regardless of method of entry. Only one Entry will be recorded on behalf of the Participant per transaction regardless of the number of hot beverages purchased in the same transaction. There is a limit of one Prize per Participant during the Appstakes Period.
6. How To Win.
A. McDonald's Appstakes Draw/Winner Notification and Odds of Winning:
On or about October 25, 2022, at 3:00 p.m. ET, the Redemption Centre, located at 55 W. Monroe, Chicago, IL 60603, USA, will randomly select one hundred potential winning Entry and three backup potential winning Entries (each a "Backup Entry") for each Entry from among all eligible Entries recorded during the corresponding Entry Period. Subject to the provisions of these Official Rules, the Participant whose Entry is selected first as a potential winning Entry will be the potential Prize winner, and that potential Prize winner will be notified to that effect by the Sponsor's redemption centre ("Redemption Centre") by email with a link to a bilingual Prize Claim form.that will be sent within approximately two business days following the date of the draw to the email address associated with the potential Prize winner's App account or, in the case of a Mail-in Entry, to the email address provided in the Mail-in Entry. The potential Prize winner will be required to complete and submit the Prize Claim form to the Redemption Centre by the date stated in the notification.,. The Prize Claim form contains, among other things, a mathematical skill-testing question (the "Skill-Testing Question"), which must be correctly answered by the potential Prize winner without any assistance, whether electronic, mechanical or otherwise. The potential winner must follow the instructions provided to complete and submit the Prize Claim form by the deadline. If the Prize winner is a minor in their province or territory of residence, the Prize winner's parent or legal guardian must complete the Prize Claim form and Skill-Testing Question on the Prize winner's behalf.
If the Prize Claim form is properly submitted and completed (and that the Skill-Testing Question is correctly answered), then that potential Prize winner will be declared the winner of the Prize and a representative of the Sponsorl will contact the winner within approximately two to four weeks following verification to confirm the Prize awarding timeline.
If the potential Prize winner fails to contact the Redemption Centre as referred to above or fails to properly complete and return the Prize Claim form by the deadline, or if their answer to the Skill-Testing Question is not correct or no answer to the Skill-Testing Question is provided, then that potential Prize winner will be disqualified from the Appstakes and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for the Prize will apply to that Participant. The Sponsor will contact up to three backup Participants for each Prize. If the prize cannot be awarded, the Prize will be forfeited and will not be awarded in the Appstakes. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that potential Prize winner will not have any claim against the Appstakes Entities or against any other person, firm or corporation in respect of the Prize, the Appstakes or any matter related to the Appstakes.
The odds of winning a Prize will depend on the number of Entries received for each Entry Period.
B. Prizes, Approximate Retail Value ("ARV"):
One Hundred Prizes are available to be won in the Appstakes. Each prize winner ("Winner") will receive seven hundred thirty thousand MyMcDonald's Points (2,000 points x 365 days). Points will be deposited in a winner's MyMcDonald's rewards account in two separate deposits of 365,000 points, approx. six months apart. Points expire six months from the date of deposit in a MyMcDonald's rewards account. Prizes are subject to terms and conditions of the MyMcDonald's rewards program, found at: https://www.mcdonalds.com/ca/en-ca/terms-and-conditions/loyaltyrewards.html, ARV: $949 each.
General Restrictions:
7. Prize/Entry Conditions/Restrictions.
Any matters concerning Prizes that are not contemplated by these Official Rules, will be determined by Sponsor in its sole discretion. Expenses not specifically stated as included in the Prizes are the sole responsibility of the Prize winners.
General Entry Conditions:
Each Participant acknowledges and agrees that the decisions of Sponsor and/or the Redemption Centre are and shall be final, binding and conclusive in all matters relating to the Appstakes. Any person attempting to forge the Prize Claim form or to defraud Sponsor in any way in connection with this Appstakes may be prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified, and any Prize potentially won will be forfeited in Sponsor's sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The Prize winner may be required to show proof of being the registered account holder.
8. General Release And Conditions of Participation.
Participants assume all risk of transmission, mailing, loss, damage, destruction, delay and misdirection of Prize Claim forms and are advised to obtain insurance where appropriate. The Appstakes Entities are not responsible for:
- a. incomplete, mislabeled, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Entries, Prize Claim form or other Appstakes-related materials whether caused by Participants, postal or courier services, wireless carriers, Internet Service Providers ("ISP") or unauthorized human intervention;
- b. any damage to a Participant's or other person's computer system or Digital Device that is caused or occasioned by accessing the McDonald's app, by participating in the Appstakes or by claiming the Prize;
- c. technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Appstakes;
- d. miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;
- e. any technical malfunctions, failures or difficulties (including failures to correctly scan the MyMcDonald's Rewards code), printing errors or omissions, clerical, typographical or other errors or omissions in any Appstakes advertisement or other materials or postings or any Prize Claim forms;
- f. any errors, omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;
- g. any incorrect or inaccurate information, whether caused by the McDonald's app or tampering, hacking or by any equipment or programming associated with, or utilized in the Appstakes; or
- h. the incorrect or inaccurate capture of information or the failure to capture or loss of any information.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Appstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Appstakes, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Prize Claim forms and Mail-in Entries submitted become the sole property of Sponsor and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Appstakes, each Participant hereby releases and agrees to hold the Appstakes Entities and all of their respective shareholders, officers, directors, agents, representatives and employees (collectively the "Released Parties"), harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Appstakes or in any Appstakes-related activity or the receipt, use or misuse of the Prize or portion thereof. Participants waive the right to assert as a cost of winning the Prize, any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim the Prize. By participating in the Appstakes, the Prize winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of his or her name, voice and likeness, along with his or her address (city and province/territory) and any statements made by or attributed to such Prize winner in any and all media, now known or hereafter devised, without prior notice, review, comment or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with the Sponsor, the Appstakes and other promotions without further compensation, and releases the Appstakes Entities from any liability with respect thereto.
9. Digital Device Requirements.
Using a Digital Device and/or operating system not supported by the McDonald's app may prevent participation in the Appstakes. While all efforts are made to support current operating systems and Digital Devices based on the McDonald's app System Requirements, new operating systems and/or Digital Devices may not be supported if brought to market after the development of this Appstakes. Sponsor is not responsible for any browser or device supporting issues.

10. Miscellaneous.
A. General:
It is each Participant's responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.
B. Force Majeure/Printing and Production Errors or Omissions:
Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Appstakes, in whole or in part, or to modify, suspend or extend the Appstakes, if it determines, in its sole discretion, that the Appstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity and/or feasibility of the Appstakes. In the event that, in the Sponsor's sole opinion, the Sponsor is impeded or prevented from continuing with the Appstakes as planned or intended by any event beyond its control, including, but not limited to, pandemic, fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor's control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Appstakes.
C. Invalidity:
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.
D. Governing Law: Except For Residents of The Province of Quebec:
Subject to any provision expressly to the contrary in these Official Rules, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Game shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction's laws. Subject only to the provisions respecting Quebec residents as set out here in Rule 10.F. of these Official Rules, all Participants, the Sponsor and all other parties hereby attorn to the jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Game or these Official Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.
E. Language or Other Discrepancy:
In the event that there is a discrepancy or inconsistency between the English-language version and the French-language version of these Official Rules or of any Declaration and Release(s), the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Appstakes Materials or in the Declaration and Release, or in advertising or other publicity or materials or communications concerning or related to the Appstakes, and the provisions in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.
F. Quebec Residents:
Residents of the Province of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses et des courses et des jeux ("Régie") for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
G. Privacy:
Sponsor will collect, use and disclose information, including personal information, provided by Participants in connection with the Appstakes for the purposes of administering the Appstakes and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from Sponsor about its products and upcoming contests and promotions. The Appstakes may be hosted on servers in the United States, and the personal information provided by Participants may therefore also be subject to the laws of the United States. Except as otherwise contemplated in these Official Rules, personal information collected, used and disclosed by the Sponsor in connection with the Appstakes will be dealt with by the Sponsor in accordance with the Sponsor's online privacy policy.
H. Cooperation in Prize Award Event(s):
In consideration of being awarded the Prize in the Appstakes, the Prize winner (and if the Prize winner is a minor, their parent or legal guardian) agrees to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of a Prize to such Prize winner.
I. Official Rules Availability:
These Official Rules will be available at the Appstakes Website until August 31, 2022. To receive a copy of the Official Rules via mail, a Participant should mail, in a postage-paid outer envelope, a self-addressed, postage-paid inner envelope to McDonald's Coffee For A Year Appstakes Official Rules Request, P.O. Box 12414, Saint John, NB, E2L 5E7. Limit one self-addressed, postage-paid envelope per outer envelope.
