McDonald’s Coffee For A Year Appstakes ("Appstakes")

Official Rules (the "Official Rules")

1. Overview.

McDonald’s Restaurants of Canada Limited (“Sponsor”) is providing its customers with a Coffee For A Year Appstakes at McDonald’s restaurants in Canada (“Appstakes”) through its McDonald’s app (the “App” or “McDonald’s app”). The App provides customers with various weekly food discounts or other food-related offers, nutrition information and benefits. The food discounts and other food-related offers may vary in content and number in different regions of Canada. The App offers customers the ability to place orders, earn MyMcDonald’s Rewards points, redeem offers or deals and, if required, pay for those offers, deals or orders via a valid charge, credit or debit card (a “Payment Card”) that the customer enters in their App settings in order to easily pick up (and pay for) their food at a participating McDonald’s restaurant via “Mobile Ordering”.

Note: a person under the age of majority in their jurisdiction of residence should only use mobile payment with the permission of a parent/legal guardian.

If a person wishes to participate in this Appstakes but does not wish to make a purchase via the McDonald’s App, or scan their MyMcDonald’s Rewards code to earn points, they can follow the instructions found in Rule 5A. to receive one entry without making a purchase from McDonald’s. In these Official Rules, an Eligible Person (refer to Rule 2) who has an entry (an “Entry”) into the Appstakes recorded on their behalf is called a “Participant”. Participants agree to comply in full with all of the provisions of these Official Rules. A Participant who wishes to download, register and activate the App to participate in the Appstakes will need an electronic device that is compatible with the App’s system requirements (“Digital Device”) and a valid email address. The Participant then must download the free App from the App Store on iOS, or Google Play on the Android operating system, and install and activate the App on their Digital Device. Go to Rule 9 for Digital Device requirements.

2. Conditions of Eligibility.

Subject to the provisions of this Rule 2, the Appstakes is available only at participating McDonald’s restaurants in Canada (excluding Quebec) to individuals 13 years of age or older.

Persons in any of the following categories are not eligible to participate in, or to win the prize (the “Prize”) in the Appstakes:

  1. a. any person who is not a resident of Canada;
  2. b. any person who, on or after April 1, 2022, was or is a director, officer, employee, member, manager, agent or franchisee of any of the Appstakes Entities (refer to Rule 3);
  3. c. any individual engaged in the development, production or distribution of materials for the Appstakes; and
  4. d. any person who is or purports to be an immediate family member (defined as spouse, dependent for federal income tax purposes, half-sister, half-brother, or step-, biological, foster, in-law or adoptive mother, father, sister, brother, daughter or son) of, or who resides or is domiciled in the same household as, any person in any of the preceding categories.

In these Rules, a person who is eligible to enter the Appstakes is called an "Eligible Person".

3. Appstakes Entities.

In these Official Rules, the term “Appstakes Entities” means Sponsor and its respective parent companies, subsidiaries, affiliates or related companies, franchisees, local advertising cooperatives and app developers, digital/advertising/promotion agencies, the Redemption Centre (defined in Rule 6).

4. The Entry Period.

For purchases made at a McDonald’s restaurant in Canada, the Appstakes period begins on September 29, 2022, at 12:00:00 a.m. local time (“LT”) and ends on October 2, 2022, at 11:59:59 p.m. LT (the "Appstakes Period").

5. How To Enter.

An Eligible Person who wishes to enter the Appstakes using their Digital Device must visit a participating McDonald’s restaurant with their Digital Device that has the McDonald’s app installed on it, “location services” enabled and a valid email address and postal code in the App settings. An Eligible Person may also enter the Appstakes without a Digital Device or making a purchase as outlined in Rule 5.B. To enter a n Eligible Person may enter the Appstakes by:

A. Purchasing any Hot Beverage Using the McDonald’s App:

An Eligible Person may use the App to order any hot beverage (Premium roast coffee, tea, latte, cappuccino, americana, mocha, deluxe hot chocolate, espresso or double espresso) by completing a transaction using their McDonald’s App or by scanning or saying their MyMcDonald’s Rewards code at the restaurant counter, kiosk or Drive-thru to earn points. One Entry will be recorded on behalf of the Participant when they complete the order purchase (via points, MOP or cash) at a participating McDonald’s restaurant.

Note: If by reason of any problem, whether mechanical, technical, due to human error or omission or other means the order cannot be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.B. for no purchase Entry.

B. Entry Via Mail Without Making a Purchase:

If an Eligible Person wishes to have one Entry recorded on their behalf without scanning a MyMcDonald’s Reward on the purchase of any Premium roast coffee, tea, latte, cappuccino, americano, mocha, deluxe hot chocolate, espresso, double espresso), that Participant must submit an entry (a “Mail-in Entry”) as follows: The Participant must manually print in ink and legibly on a piece of paper their complete name, street address (including unit number (if applicable), province/territory and postal code), a daytime telephone number (including area code) and their valid email address; then that Participant must place that paper in a postage-paid envelope, and mail it to: McDonald’s Coffee For A Year Appstakes Entry, P.O. Box 12442, Saint John, NB E2L 5E7. A Mail-in Entry must be postmarked no later than October 3, 2022 (the “AMOE Postmarked by Date”) for receipt by October 17, 2022. Outer envelopes for Mail-in Entries with no return address will NOT be honoured. Mail-in Entries that are sent in business-reply envelopes, sent in envelopes that utilize or bear address labels or stickers, that are photocopied, hand-stamped, computer-generated or otherwise mechanically produced or reproduced, that are not addressed manually in ink, that fail in any way to comply with the requirements set out above in this sub-paragraph or that are not mailed separately in separate envelopes bearing sufficient postage will NOT be honoured (i.e., there can be only one Mail-in Entry per envelope). Or not received by the deadline, no Entry will be recorded on behalf of the person who submitted that envelope. One Entry will be recorded on behalf of a Participant for each Mail-in Entry they submit that is in full compliance with the requirements set out in this Rule 5.B. (Each Entry, including a Mail-in Entry, are collectively referred to as “Entries”.)

C. Limits:

There is a limit of three Entries per Eligible Person per day (based on local time) regardless of method of entry. Only one Entry will be recorded on behalf of the Participant per transaction regardless of the number of hot beverages purchased in the same transaction. There is a limit of one Prize per Participant during the Appstakes Period.

6. How To Win.

A. McDonald’s Appstakes Draw/Winner Notification and Odds of Winning:

On or about October 25, 2022, at 3:00 p.m. ET, the Redemption Centre, located at 55 W. Monroe, Chicago, IL 60603, USA, will randomly select one hundred potential winning Entry and three backup potential winning Entries (each a “Backup Entry”) for each Entry from among all eligible Entries recorded during the corresponding Entry Period. Subject to the provisions of these Official Rules, the Participant whose Entry is selected first as a potential winning Entry will be the potential Prize winner, and that potential Prize winner will be notified to that effect by the Sponsor’s redemption centre (“Redemption Centre") by email with a link to a bilingual Prize Claim form.that will be sent within approximately two business days following the date of the draw to the email address associated with the potential Prize winner’s App account or, in the case of a Mail-in Entry, to the email address provided in the Mail-in Entry. The potential Prize winner will be required to complete and submit the Prize Claim form to the Redemption Centre by the date stated in the notification.,. The Prize Claim form contains, among other things, a mathematical skill-testing question (the “Skill-Testing Question”), which must be correctly answered by the potential Prize winner without any assistance, whether electronic, mechanical or otherwise. The potential winner must follow the instructions provided to complete and submit the Prize Claim form by the deadline. If the Prize winner is a minor in their province or territory of residence, the Prize winner’s parent or legal guardian must complete the Prize Claim form and Skill-Testing Question on the Prize winner’s behalf.

If the Prize Claim form is properly submitted and completed (and that the Skill-Testing Question is correctly answered), then that potential Prize winner will be declared the winner of the Prize and a representative of the Sponsorl will contact the winner within approximately two to four weeks following verification to confirm the Prize awarding timeline.

If the potential Prize winner fails to contact the Redemption Centre as referred to above or fails to properly complete and return the Prize Claim form by the deadline, or if their answer to the Skill-Testing Question is not correct or no answer to the Skill-Testing Question is provided, then that potential Prize winner will be disqualified from the Appstakes and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for the Prize will apply to that Participant. The Sponsor will contact up to three backup Participants for each Prize. If the prize cannot be awarded, the Prize will be forfeited and will not be awarded in the Appstakes. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that potential Prize winner will not have any claim against the Appstakes Entities or against any other person, firm or corporation in respect of the Prize, the Appstakes or any matter related to the Appstakes.

The odds of winning a Prize will depend on the number of Entries received for each Entry Period.

B. Prizes, Approximate Retail Value ("ARV"):

One Hundred Prizes are available to be won in the Appstakes. Each prize winner (“Winner”) will receive seven hundred thirty thousand MyMcDonald’s Points (2,000 points x 365 days). Points will be deposited in a winner’s MyMcDonald’s rewards account in two separate deposits of 365,000 points, approx. six months apart. Points expire six months from the date of deposit in a MyMcDonald’s rewards account. Prizes are subject to terms and conditions of the MyMcDonald’s rewards program, found at: https://www.mcdonalds.com/ca/en-ca/terms-and-conditions/loyaltyrewards.html, ARV: $949 each.

General Restrictions:

7. Prize/Entry Conditions/Restrictions.

Any matters concerning Prizes that are not contemplated by these Official Rules, will be determined by Sponsor in its sole discretion. Expenses not specifically stated as included in the Prizes are the sole responsibility of the Prize winners.

General Entry Conditions:

Each Participant acknowledges and agrees that the decisions of Sponsor and/or the Redemption Centre are and shall be final, binding and conclusive in all matters relating to the Appstakes. Any person attempting to forge the Prize Claim form or to defraud Sponsor in any way in connection with this Appstakes may be prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified, and any Prize potentially won will be forfeited in Sponsor’s sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The Prize winner may be required to show proof of being the registered account holder.

8. General Release And Conditions of Participation.

Participants assume all risk of transmission, mailing, loss, damage, destruction, delay and misdirection of Prize Claim forms and are advised to obtain insurance where appropriate. The Appstakes Entities are not responsible for:

  1. a. incomplete, mislabeled, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Entries, Prize Claim form or other Appstakes-related materials whether caused by Participants, postal or courier services, wireless carriers, Internet Service Providers (“ISP”) or unauthorized human intervention;
  2. b. any damage to a Participant’s or other person’s computer system or Digital Device that is caused or occasioned by accessing the McDonald’s app, by participating in the Appstakes or by claiming the Prize;
  3. c. technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Appstakes;
  4. d. miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;
  5. e. any technical malfunctions, failures or difficulties (including failures to correctly scan the MyMcDonald’s Rewards code), printing errors or omissions, clerical, typographical or other errors or omissions in any Appstakes advertisement or other materials or postings or any Prize Claim forms;
  6. f. any errors, omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;
  7. g. any incorrect or inaccurate information, whether caused by the McDonald’s app or tampering, hacking or by any equipment or programming associated with, or utilized in the Appstakes; or
  8. h. the incorrect or inaccurate capture of information or the failure to capture or loss of any information.

Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Appstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Appstakes, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Prize Claim forms and Mail-in Entries submitted become the sole property of Sponsor and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Appstakes, each Participant hereby releases and agrees to hold the Appstakes Entities and all of their respective shareholders, officers, directors, agents, representatives and employees (collectively the “Released Parties”), harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Appstakes or in any Appstakes-related activity or the receipt, use or misuse of the Prize or portion thereof. Participants waive the right to assert as a cost of winning the Prize, any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim the Prize. By participating in the Appstakes, the Prize winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of his or her name, voice and likeness, along with his or her address (city and province/territory) and any statements made by or attributed to such Prize winner in any and all media, now known or hereafter devised, without prior notice, review, comment or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with the Sponsor, the Appstakes and other promotions without further compensation, and releases the Appstakes Entities from any liability with respect thereto.

9. Digital Device Requirements.

Using a Digital Device and/or operating system not supported by the McDonald’s app may prevent participation in the Appstakes. While all efforts are made to support current operating systems and Digital Devices based on the McDonald’s app System Requirements, new operating systems and/or Digital Devices may not be supported if brought to market after the development of this Appstakes. Sponsor is not responsible for any browser or device supporting issues.

10. Miscellaneous.

A. General:

It is each Participant’s responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.

B. Force Majeure/Printing and Production Errors or Omissions:

Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Appstakes, in whole or in part, or to modify, suspend or extend the Appstakes, if it determines, in its sole discretion, that the Appstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity and/or feasibility of the Appstakes. In the event that, in the Sponsor’s sole opinion, the Sponsor is impeded or prevented from continuing with the Appstakes as planned or intended by any event beyond its control, including, but not limited to, pandemic, fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Appstakes.

C. Invalidity:

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.

D. Governing Law: Except For Residents of The Province of Quebec:

Subject to any provision expressly to the contrary in these Official Rules, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Game shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction’s laws. Subject only to the provisions respecting Quebec residents as set out here in Rule 10.F. of these Official Rules, all Participants, the Sponsor and all other parties hereby attorn to the jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Game or these Official Rules and agree that any such determination shall be brought solely and exclusively before such courts in the Province of Ontario.

E. Language or Other Discrepancy:

In the event that there is a discrepancy or inconsistency between the English-language version and the French-language version of these Official Rules or of any Declaration and Release(s), the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Appstakes Materials or in the Declaration and Release, or in advertising or other publicity or materials or communications concerning or related to the Appstakes, and the provisions in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.

F. Quebec Residents:

Residents of the Province of Quebec may submit any litigation respecting the conduct or organization of a publicity contest to the Régie des alcools, des courses et des courses et des jeux (“Régie”) for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

G. Privacy:

Sponsor will collect, use and disclose information, including personal information, provided by Participants in connection with the Appstakes for the purposes of administering the Appstakes and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from Sponsor about its products and upcoming contests and promotions. The Appstakes may be hosted on servers in the United States, and the personal information provided by Participants may therefore also be subject to the laws of the United States. Except as otherwise contemplated in these Official Rules, personal information collected, used and disclosed by the Sponsor in connection with the Appstakes will be dealt with by the Sponsor in accordance with the Sponsor's online privacy policy.

H. Cooperation in Prize Award Event(s):

In consideration of being awarded the Prize in the Appstakes, the Prize winner (and if the Prize winner is a minor, their parent or legal guardian) agrees to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of a Prize to such Prize winner.

I. Official Rules Availability:

These Official Rules will be available at the Appstakes Website until August 31, 2022. To receive a copy of the Official Rules via mail, a Participant should mail, in a postage-paid outer envelope, a self-addressed, postage-paid inner envelope to McDonald’s Coffee For A Year Appstakes Official Rules Request, P.O. Box 12414, Saint John, NB, E2L 5E7. Limit one self-addressed, postage-paid envelope per outer envelope.

The App offers customers the ability to place orders, earn MyMcDonald’s Rewards points, redeem offers or deals and, if required, pay for those offers, deals or orders via a valid charge, credit or debit card (a “Payment Card”) that the customer enters in their App settings in order to easily pick up (and pay for) their food at a participating McDonald’s restaurant via “Mobile Ordering”.

    In these Official Rules, the term “Appstakes Entities” means Sponsor, Universal City Development Partners, Ltd. d/b/a Universal Orlando Resort (“Universal Orlando”) and Universal City Studios, LLC d/b/a Universal Studios Hollywood (“Universal Studios Hollywood”) (collectively referred to herein as “Universal” and “Prize Partner”) and their respective parent companies, subsidiaries, affiliates or related companies, franchisees, local advertising cooperatives and app developers, digital/advertising/promotion agencies, the Redemption Centre (defined in Rule 6).

  4. 4. The Entry Period.

    For purchases made at a McDonald’s restaurant in Canada (except in Quebec), the Appstakes period begins on June 21, 2022, at 12:00:00 a.m. local time (“LT”) and ends on July 18, 2022, at 11:59:59 p.m. LT (the “Appstakes Period”). The Appstakes Period includes four separate entry periods (each an “Entry Period”, and collectively the “Entry Periods”) as shown below. Entries into one Entry Period do not result in an Entry into any subsequent Entry Period (if any).

    The Appstakes Period includes four separate Entry Periods, during which an Eligible Person has three different ways to have an Entry into the Appstakes recorded on their behalf. An Eligible Person who wishes to enter the Appstakes using their Digital Device must visit a participating McDonald’s restaurant with their Digital Device that has the McDonald’s app installed on it, “location services” enabled and a valid email address and postal code in the App settings. An Eligible Person may also enter the Appstakes without a Digital Device or making a purchase as outlined in Rule 5.D. To enter via Mobile Ordering (via table service, self-order kiosk, at the front counter, or at the drive-thru or via curbside of a participating McDonald’s Restaurant), a Participant must have a valid Payment Card in their App settings or have sufficient MyMcDonald’s Rewards Points to redeem for a Happy Meal®. An Eligible Person may enter the Appstakes by:

    1. A. Purchasing any Happy Meal Using Mobile Ordering

      An Eligible Person may use the App to order any Happy Meal during the hours when that item is being served. Purchase can be made using a Payment Card or redeeming MyMcDonald’s Rewards Points. One Entry will be recorded on behalf of the Participant when they place a Mobile Order for pick up in-restaurant, via curbside service, or via drive-thru at a participating McDonald’s restaurant (excluding Quebec).

      Note: If by reason of any problem, whether mechanical, technical, due to human error or omission or other means the order cannot be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.D. for no purchase Entry.

    2. B. Scanning your MyMcDonald’s Rewards code on the McDonald’s app with the purchase of any Happy Meal in-restaurant or drive-thru:

      An Eligible Person will automatically have one Entry recorded on their behalf when they scan their MyMcDonald’s Rewards code on the McDonald’s app to earn or redeem MyMcDonald’s Rewards Points on the purchase of any Happy Meal in-restaurant via table service, front counter, self-order kiosk or via drive-thru when that item is being served during the Entry Period at any participating McDonald’s restaurant in Canada (except in Quebec).

      Note: If for any reason the Participant does not complete their purchase, then no Entry will be recorded. If due to any mechanical, technical or human error, a Participant’s order can’t be completed, no Entry will be recorded. Please refer to the instructions below in Rule 5.D. for no purchase Entry.

    3. C. Purchasing any Happy Meal Using Mobile Ordering or Scanning your MyMcDonald’s Rewards code on the McDonald’s app with the purchase of any Happy Meal in-restaurant or via drive-thru to Collect MyMcDonald’s Reward Points on weekdays between 4 p.m. and 7 p.m. LT to Receive Five Bonus Entries:

      A Participant will automatically have five bonus Entries recorded on their behalf for the applicable Entry Period when they earn an Entry under Rule 5.A. or 5.B. weekdays only, between 4 p.m. LT and 7 p.m. LT.

    4. D. Entry Via Mail Without Making a Purchase:

      If an Eligible Person wishes to have six Entries recorded on their behalf without using Mobile Ordering of any Happy Meal, or scanning a MyMcDonald’s Reward code to earn or redeem rewards points on the purchase of any Happy Meal, that Participant must submit an entry (a “Mail-in Entry”) as follows: The Participant must manually print in ink and legibly on a piece of paper their complete name, street address (including unit number (if applicable), province/territory and postal code), a daytime telephone number (including area code) and their valid email address; then that Participant must place that paper in a postage-paid envelope, on the bottom-left front of which they print the Entry Period (1, 2, 3 or 4) for which the Mail-in Entry is being submitted, and mail it to: Minions Appstakes Entry, P.O. Box 12415, Saint John, New Brunswick, Canada, E2L 5E7. A Mail-in Entry must be postmarked no later than the date shown in the chart (the “AMOE Postmarked by Date” column) in Rule 4. Outer envelopes for Mail-in Entries with no return address or no Entry Period date on the outside will NOT be honoured. Mail-in Entries that are sent in business-reply envelopes, sent in envelopes that utilize or bear address labels or stickers, that are photocopied, hand-stamped, computer-generated or otherwise mechanically produced or reproduced, that are not addressed manually in ink, that fail in any way to comply with the requirements set out above in this sub-paragraph or that are not mailed separately in separate envelopes bearing sufficient postage will NOT be honoured (i.e., there can be only one Mail-in Entry per envelope). The weekly Entry Period into which a Mail-in Entry will be included will be determined by the date indicated on the front of the envelope, provided the Mail-in Entry is postmarked by the Postmarked by Date and received by the AMOE Received by Date corresponding to that Entry Period (see chart in Rule 4 above). If a Mail-in Entry is received after the date identified in Rule 4 for the Entry Period printed on the front of the envelope, no Entry will be recorded on behalf of the person who submitted that envelope. One Entry will be recorded on behalf of a Participant for each Mail-in Entry they submit that is in full compliance with the requirements set out in this Rule 5.D. (Each Entry, including a Mail-in Entry, are collectively referred to as “Entries”.)

    5. E. Limits:

      There is a limit of six Entries per Eligible Person per day (based on local time) regardless of method of entry. Only one Entry will be recorded on behalf of the Participant per transaction (except weekdays between 4 p.m. and 7 p.m. LT when six Entries will be recorded – one Entry and five bonus Entries - per transaction) regardless of the number of Happy Meals purchased in the same transaction. There is a limit of one Prize per Participant during the Appstakes Period.

  6. 6. How To Win.

    1. A. McDonald’s Appstakes Draw/Winner Notification and Odds of Winning:

      On or about August 2, 2022, at 3:00 p.m. ET, the Redemption Centre, located at 55 W. Monroe, Chicago, IL 60603, USA, will randomly select one potential winning Entry and three backup potential winning Entries (each a “Backup Entry”) for each Entry Period from among all eligible Entries recorded during the corresponding Entry Period. Subject to the provisions of these Official Rules, the Participant whose Entry is selected first as a potential winning Entry will be the potential Prize winner, and that potential Prize winner will be notified to that effect by the Sponsor’s redemption centre (“Redemption Centre”) by email as follows: the potential winning notification will be sent via email within two business days following the date of the draw to the email address associated with the potential Prize winner’s App account or, in the case of a Mail-in Entry, to the email address provided in the Mail-in Entry. The potential Prize winner will be required to contact the Redemption Centre, in accordance with the information provided in the email, and to do so by the date stated in that email. If that contact occurs, the Redemption Centre will supply the potential Prize winner with certain Prize claim documents (the “Prize Claim Documents”), together with instructions to complete and submit the Prize Claim Documents electronically (or via mail) to the Redemption Centre, and stating the deadline by which those completed Prize Claim Documents must be received by the Redemption Centre. The Prize Claim Documents will comprise a declaration and release (a “Declaration and Release”). The Declaration and Release contains, among other things, a release of liability, a publicity release and a mathematical skill-testing question (the “Skill-Testing Question”), which must be correctly answered by the potential Prize winner without any assistance, whether electronic, mechanical or otherwise. The potential winner must follow instructions provided to complete and submit the Declaration and Release. If the Prize winner is a minor in their province or territory of residence, the Prize winner’s parent or legal guardian must complete the Declaration and Release on the Prize winner’s behalf.

      If the Redemption Centre finds that the Prize Claim Documents are properly submitted and completed (and that the Skill-Testing Question is correctly answered), then that potential Prize winner will be declared the winner of the Prize and a representative of Universal will contact the winner within approximately two to four weeks following verification to arrange for the Prize.

      If the potential Prize winner fails to contact the Redemption Centre as referred to above or fails to properly complete and return the Prize Claim Documents by the deadline, or if their answer to the Skill-Testing Question is not correct or no answer to the Skill-Testing Question is provided, then that potential Prize winner will be disqualified from the Appstakes and will not receive the applicable Prize. In such a case, the Participant on whose behalf the first Backup Entry drawn was recorded will be notified by the Redemption Centre and the process described above for the Prize will apply to that Participant. The Sponsor will contact up to three backup Participants for each Prize. If the prize cannot be awarded, the Prize will be forfeited and will not be awarded in the Appstakes. If, for any reason, a Participant whose Entry is drawn is not declared the winner of the Prize, then that potential Prize winner will not have any claim against the Appstakes Entities or against any other person, firm or corporation in respect of the Prize, the Appstakes or any matter related to the Appstakes.

      The odds of winning a Prize will depend on the number of Entries received for each Entry Period.

    2. B. Prizes, Approximate Retail Value (“ARV”):

      Four Prizes are available to be won in the Appstakes, one Prize for each of the four Entry Periods. Each prize winner (“Winner”) will receive a four day, three night trip for Winner and up to three (3) guests (“Guest”) to one of the following two destinations, as selected by the Winner: either (a) Universal Orlando Resort in Orlando, Florida, Approximate Retail Value (“ARV”): $6,216.49 CAD based on a Toronto departure example; or (b) Universal Studios Hollywood in Hollywood, California ARV: $6,373.05 CAD based on a Toronto departure example.

      1. a. If the Universal Orlando Resort destination is chosen, Prize will include round trip economy class air transportation for Winner and up to three Guests from a major commercial airport near Winner’s home in Canada (as determined by Universal in their sole discretion) to Orlando, FL; three nights’ standard hotel accommodation (one room, quadruple occupancy, room and tax only) at Universal’s Cabana Bay Beach Resort or at another Universal Orlando Resort hotel (as determined by Universal Orlando in their sole discretion); non-exclusive ground transportation to and from airport and hotel in Orlando, FL; 3-Day/3-Park Park-to-Park tickets for admission to Universal Studios Florida, Universal’s Islands of Adventure and Universal’s Volcano Bay Water Theme Park, for Winner and up to three Guests.
      2. b. If the Universal Studios Hollywood destination is chosen, Prize will include round trip coach class air transportation for Winner and up to three Guests from a major commercial airport near Winner’s home in Canada (as determined by Universal in their sole discretion) to Los Angeles, CA; three nights’ standard hotel accommodation (one room, quadruple occupancy, room and tax only) at Sheraton Universal Hotel (or at another nearby hotel as determined by Universal in their sole discretion); non-exclusive ground transportation to and from airport and hotel in Los Angeles, CA; and three day General Admission tickets to Universal Studios Hollywood for Winner and up to three Guests.

      Trip must be completed by July 11, 2023 or Prize will be forfeited. Travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Travel dates are subject to Universal and Sponsor approval. Reservations are subject to availability. Trip must be booked at least sixty days prior to intended departure date. If Winner elects to partake in any or all portions of his/her Prize with fewer than the allotted number of Guests or no Guest, the Prize will be awarded to Winner and each participating Guest and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. If Winner is under the age of majority in their province/territory of residence, Winner’s parent or legal guardian must accept the prize on their behalf. If Winner (or Winner’s parent or legal guardian, if Winner is under the age of eighteen) is under twenty-one years of age, he/she must be accompanied by an adult of at least twenty-one (21) years of age in order to check into the hotel. Unless winner or a child or ward of Winner or one of the allotted Guests, each Guest must be eighteen years of age or older as of the date of departure and must travel on the same itinerary and at the same time as the Winner. Actual value of Prize may vary depending upon the points of departure, ground transportation, and/or airline fare fluctuations; any difference between stated ARV and actual Prize value of Prize will not be awarded. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, COVID testing (if applicable), baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of Winner. Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, baggage fees, and security charges. Winner and Guests are responsible for obtaining, at their own expense, any necessary travel documentation (i.e. valid photo identification, visas, passports, proof of COVID-19 vaccination (if required), etc.) prior to travel. Once issued, tickets are nontransferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Travel arrangements must be made through Universal.

      In connection with any visit to Universal Orlando Resort and/or Universal Studios Hollywood and any travel related to the Prize, please be advised that Universal’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, guests should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before and after visiting any Universal destination. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Universal cannot guarantee that any person will not be exposed during a visit.

      All parts of the Prize selected are subject to availability and blackout dates, and subject to change without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this promotion occurs, render the redemption or fulfilment of some or all of the prize delayed, hindered, adversely affected, impracticable, or impossible, Universal in its sole and absolute discretion, reserves the right to evaluate and make modifications to the redemption and fulfilment processes and timelines for any Prize or portion of the Prize that Universal is responsible for, which may include but is not limited to providing additional time for redemption and/ or fulfilment. Should the Prize become unavailable, experiences and items of a similar nature and value may be offered. Sponsor and Universal are not responsible in the event that any Winner or Guest is denied the ability to fly out of or into any particular airport, whether due to airport restrictions, government restrictions or otherwise.

      General Restrictions: Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Sponsor and Universal shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, Prize Partner or any other persons providing any Prize-related services or accommodations. Additional Prize award details and travel information to be provided to the Winner at the time of notification.

      Universal is a prize provider only in this promotion; is not a sponsor of this promotion; and is not responsible for the administration of the promotion, the collection of the Entries or the conduct of the draws. All disputes, claims and causes of action against Universal Orlando Resort arising out of or relating to any person’s use of, or participation in any portion of the Universal Orlando Resort Prize involving Universal Orlando Resort (“UO Prize Claims”) shall be resolved by applying the laws of Florida, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in state or federal courts within Orange County, Florida. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees. Any disputes, claims and causes of action against Universal Studios Hollywood arising out of or relating to any person’s use of, or participation in the Universal Studios Hollywood Prize involving Universal Studios Hollywood (“USH Prize Claims”) shall be fully and finally adjudicated by binding arbitration to the fullest extent allowed by law ( an “Arbitration”) in Los Angeles, California. The Arbitration shall be administered by JAMS in accordance with the Streamlined Arbitration Rules and Procedure of JAMS (available at https://www.jamsadr.com/rules-streamlined-arbitration/) or subsequent versions thereof, including the optional appeal procedure.

    3. C. Additional Prize Conditions/Limitations.

      Winner and Guests are solely responsible for fulfilling any/all travel and security requirements (including but not limited to any shots, medical tests or other health requirements necessary to visit certain destinations and any quarantine requirements that may be required). Each Guest (and in the event of a Minor, their parent or legal guardian) will be required to execute a guest release prior to the issue of any travel documents. No insurance whatsoever is provided as part of the Prize or furnished by the Sponsor or Universal, and obtaining any insurance, such as (but not limited to) travel insurance, cancellation insurance, trip delay, health, accident or medical insurance, and property or luggage loss or other damage insurance is the sole responsibility of the Winner and at the sole cost of the Winner and that Winner’s Guests. Sponsor or Universal reserve the right in their respective sole discretion to designate all flight/travel particulars and route or routes (as the case may be). Flight schedules are subject to change without notice. No Released Party (as defined in Rule 8) will be liable for any missed opportunities or expenses incurred as a consequence of flight cancellation/travel restrictions/delay or ground transportation delay. Sponsor and/or Universal make no express or implied warranties of any kind with respect to safety, or performance, of the trip/travel services package or any component thereof. If a Winner (and/or Guest(s)) is/are not able to participate in any portion of a travel Prize, that unused portion will not be substituted for cash or in any other way. Restrictions and/or blackout dates may apply. Once a Winner has identified their Guests in accordance with the provisions of these Official Rules, the Guests cannot be changed without the express consent of Sponsor and/or Universal, which consent may be withheld for any reason. Each Winner (and in consideration of being permitted by the Sponsor to participate in the Prize, each guest) agrees to maintain their dress, behaviour and comportment in accordance with all applicable laws and generally accepted social practices in connection with the travel related to the Prize and in connection with participation in any Prize-related event or activity. Winners and their Guests understand and agree that the Sponsor and, when applicable, Universal has/have the right, in its/their sole discretion, to disqualify and remove a Winner or any Guest from any travel at any time if that Winner or Guest’s behaviour at any point is uncooperative, disruptive or may or does cause damage to person, property or the reputation of the Sponsor, Universal and/or any third party or otherwise violates the policies of the Sponsor, Universal or both. The Winner is entirely and solely responsible for the dress, behaviour and comportment of their Guests.

      Note: No Prize Winner or any of their Guests may sell, transfer or dispose of any part of this Prize to any other person without the Sponsor’s and/or Universal’s prior written consent which may be withheld in their sole discretion.

      Travel, entertainment and theme park tickets are subject to certain terms and conditions as specified thereon. All theme park tickets are valid during normal operating hours only. Operating hours and availability of attractions and shows are subject to change without notice. Some special events may be separately ticketed. Universal reserves the right to change the name of all tickets. Unless otherwise noted, all tickets specifically exclude admission to special or separately ticketed “hard ticket” entertainment events at any of the theme parks, hotels, or within any of the Universal CityWalk venues such as Hard Rock Live®. Winner and Guests must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the Prize.

  7. 7. Prize/Entry Conditions/Restrictions.

    Any matters concerning Prizes that are not contemplated by these Official Rules, will be determined by Sponsor in its sole discretion. Expenses not specifically stated as included in the Prizes are the sole responsibility of the Prize winners.

    General Entry Conditions:

    Each Participant acknowledges and agrees that the decisions of Sponsor and/or the Redemption Centre are and shall be final, binding and conclusive in all matters relating to the Appstakes. Any person attempting to forge Prize Claim Documents or to defraud Sponsor in any way in connection with this Appstakes may be prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of a Participant, the Participant will be the registered account holder of the email address associated with the disputed Entry, but only if that person meets all other eligibility criteria. Otherwise, the Entry may be disqualified, and any Prize potentially won will be forfeited in Sponsor’s sole discretion. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The Prize winner may be required to show proof of being the registered account holder.

  8. 8. General Release And Conditions of Participation.

    Participants assume all risk of transmission, mailing, loss, damage, destruction, delay and misdirection of Prize Claim Documents and are advised to obtain insurance where appropriate. The Appstakes Entities are not responsible for:

    1. a. incomplete, mislabeled, misdirected, late, lost, garbled, unintelligible, damaged, stolen, non-delivered or postage-due submissions of Entries, Prize Claim Documents or other Appstakes-related materials whether caused by Participants, postal or courier services, wireless carriers, Internet Service Providers (“ISP”) or unauthorized human intervention;
    2. b. any damage to a Participant’s or other person’s computer system or Digital Device that is caused or occasioned by accessing the McDonald’s app, by participating in the Appstakes or by claiming the Prize;
    3. c. technical difficulties or failures of any kind including, but not limited to, lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet, Digital Device or wireless carriers, websites or other connection, availability or accessibility problems arising in connection with or over the course of the Appstakes;
    4. d. miscommunications, failed, jumbled, scrambled, delayed, dropped, interrupted, lost, non-delivered or misdirected computer, telephone, Digital Device, email, mobile or cable transmissions or hardware, software, program or programming malfunctions, failures or difficulties of any kind including, but not limited to: malfunctions, interruptions or disconnections in transmissions or connections, phone lines, network hardware or software, computers, equipment, programming errors, cable, satellite, cellular tower or ISP or wireless carriers;
    5. e. any technical malfunctions, failures or difficulties (including failures to correctly scan the MyMcDonald’s Rewards code), printing errors or omissions, clerical, typographical or other errors or omissions in any Appstakes advertisement or other materials or postings or any Prize Claim Documents;
    6. f. any errors, omissions or failures of any kind, whether human, mechanical, clerical, electronic, interruption of power, digital, mobile or technical in nature, or unauthorized human intervention;
    7. g. any incorrect or inaccurate information, whether caused by the McDonald’s app or tampering, hacking or by any equipment or programming associated with, or utilized in the Appstakes; or
    8. h. the incorrect or inaccurate capture of information or the failure to capture or loss of any information.

    Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering or interfering in any way with the operation or conduct of the Appstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the apparent intent to disrupt or undermine the legitimate operation of the Appstakes, or to annoy, abuse, threaten or harass any other person. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Prize Claim Documents and Mail-in Entries submitted become the sole property of Sponsor and will not be returned. Sponsor shall not be responsible to correspond with Participants. By participating in the Appstakes, each Participant hereby releases and agrees to hold the Appstakes Entities and all of their respective shareholders, officers, directors, agents, representatives and employees (collectively the “Released Parties”), harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitation, property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in the Appstakes or in any Appstakes-related activity or the receipt, use or misuse of the Prize or portion thereof. Participants waive the right to assert as a cost of winning the Prize, any and all costs of verification and redemption or travel to claim the Prize and any liability and publicity which might arise from claiming or seeking to claim the Prize. By participating in the Appstakes, the Prize winner hereby agrees and grants Sponsor the right, but not the obligation, to the use of his or her name, voice and likeness, along with his or her address (city and province/territory) and any statements made by or attributed to such Prize winner in any and all media, now known or hereafter devised, without prior notice, review, comment or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with the Sponsor, the Appstakes and other promotions without further compensation, and releases the Appstakes Entities from any liability with respect thereto.

  9. 9. Digital Device Requirements.

    Using a Digital Device and/or operating system not supported by the McDonald’s app may prevent participation in the Appstakes. While all efforts are made to support current operating systems and Digital Devices based on the McDonald’s app System Requirements, new operating systems and/or Digital Devices may not be supported if brought to market after the development of this Appstakes. Sponsor is not responsible for any browser or device supporting issues.

  10. 10. Miscellaneous.

    1. A. General:

      It is each Participant’s responsibility to ensure that they have complied in full with all of the conditions and requirements contained in these Official Rules.

    2. B. Force Majeure/Printing and Production Errors or Omissions:

      Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate the Appstakes, in whole or in part, or to modify, suspend or extend the Appstakes, if it determines, in its sole discretion, that the Appstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, integrity and/or feasibility of the Appstakes. In the event that, in the Sponsor’s sole opinion, the Sponsor is impeded or prevented from continuing with the Appstakes as planned or intended by any event beyond its control, including, but not limited to, pandemic, fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate the Appstakes.

    3. C. Invalidity:

      The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Official Rules solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of these Official Rules or any provision hereof. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules.

    4. D. Governing Law:

      1. (a) all Participants, the Sponsor and all other parties hereby attorn to the jurisdiction of the courts of the Province of Ontario, sitting in the City of Toronto, Ontario, in respect of the determination of any matter or dispute arising under or in respect of the Appstakes (exclusive of UO Prize Claims and USH Prize Claims defined above); and,

      2. (b) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with the Appstakes shall be governed by and construed and interpreted in accordance with the federal laws of Canada, and in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those Ontario laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause or bring about the application of any other jurisdiction’s laws.

    5. E. Language or Other Discrepancy:

      In the event that there is a discrepancy or inconsistency between the English-language version and the French-language version of these Official Rules or of any Declaration and Release(s), the English version shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Appstakes Materials or in the Declaration and Release, or in advertising or other publicity or materials or communications concerning or related to the Appstakes, and the provisions in these Official Rules, the provisions in these Official Rules shall prevail, govern and control.

    6. F. Privacy:

      Sponsor will collect, use and disclose information, including personal information, provided by Participants in connection with the Appstakes for the purposes of administering the Appstakes and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from Sponsor about its products and upcoming contests and promotions. The Appstakes may be hosted on servers in the United States, and the personal information provided by Participants may therefore also be subject to the laws of the United States. Except as otherwise contemplated in these Official Rules, personal information collected, used and disclosed by the Sponsor in connection with the Appstakes will be dealt with by the Sponsor in accordance with the Sponsor’s online privacy policy.

    7. G. Cooperation in Prize Award Event(s):

      In consideration of being awarded the Prize in the Appstakes, the Prize winner (and if the Prize winner is a minor, their parent or legal guardian) agrees to participate fully and without compensation in any announcement(s) and/or presentation ceremony/ceremonies and/or event or events organized or presented by the Sponsor in its sole discretion related to the granting of a Prize to such Prize winner.

    8. H. Official Rules Availability:

      These Official Rules will be available at the Appstakes Website until August 31, 2022. To receive a copy of the Official Rules via mail, a Participant should mail, in a postage-paid outer envelope, a self-addressed, postage-paid inner envelope to McDonald’s Appstakes Official Rules Request, P.O. Box 12414, Saint John, NB, E2L 5E7. Limit one self-addressed, postage-paid envelope per outer envelope.
